Clear terms, a calm order

All the rules that apply to your order, from product selection to after-sales service.

Article 1 — Purpose and scope

These General Terms and Conditions of Sale govern all sales made on petanqueland.fr between the seller and any non-business buyer (the Customer). Placing an order means accepting these terms in full. The seller may amend them at any time; the applicable version is the one in force on the order date.

Article 3 — Products

Products for sale are presented with their essential characteristics on their product pages. Photographs and visuals are not contractually binding. Products comply with applicable French law.

Article 4 — Prices

Prices are shown in euros (€), including all taxes, excluding any delivery charges stated before the order is confirmed. VAT not applicable under article 293 B of the French tax code. Prices may be changed at any time; the Customer is charged the price shown when the order is recorded. A clear pricing error may lead to cancellation with notice to the Customer.

Article 5 — Orders

The Customer selects products, adds them to the cart and confirms the order after checking its contents. Confirmation, acceptance of these terms and payment confirmation constitute the sales contract. The seller may refuse or cancel an order in case of a dispute, an abnormal order or bad faith.

Article 6 — Payment and retention of title

Payment is made online by bank card or another offered method, including Stripe and Klarna, through a secure system. The order is effective only after payment is collected. The seller does not retain bank details. Products remain the seller’s property until paid in full.

Article 7 — Availability

Offers remain valid while visible on the site and subject to available stock. If a product becomes unavailable after ordering, the Customer is informed and refunded for that product, with no additional compensation.

Article 8 — Delivery

Products are shipped only to France and Belgium. Delivery is free in France. Delivery to Belgium costs €5 and is added to the cart before payment. Delivery times are indicative. Loss or damage risk transfers when the Customer or their nominated third party physically receives the goods. The Customer must check the parcel and report any issue under article 10.

Article 9 — Right of withdrawal

Under articles L221-18 and following of the French Consumer Code, the Customer has fourteen (14) days from receipt to withdraw without giving a reason. The procedure, conditions and exceptions are set out in the Refund and Returns Policy, which forms part of these terms.

Article 10 — Returns, damaged parcels and refunds

Returns follow the Refund and Returns Policy: prior email approval, product returned new and complete, return costs paid by the Customer. Transport damage or an error must be reported within 48 hours of receipt to contact@petanqueland.fr, with photographs. An incomplete, damaged or used return may receive a reduced refund or be refused.

Article 11 — Legal warranties

In addition to any commercial warranty, the Customer benefits from the French legal warranty of conformity under articles L217-3 and following of the Consumer Code and the warranty for hidden defects under articles 1641 and following of the Civil Code.

Article 12 — Liability

The seller is not liable for failure caused by the Customer, a third party or force majeure, nor for indirect damage. Books provide educational methods, advice and exercises: use is the reader’s responsibility and no sporting result or performance is guaranteed.

Article 13 — Intellectual property

All books, content, text, exercises, visuals and trademarks on the site and in the products are protected by copyright and trademark law. Any reproduction, representation, modification, resale, lending, sharing or distribution, in whole or in part, without written permission is prohibited and may constitute infringement.

Article 14 — Personal data

Collected data is needed to process orders and is handled under the Privacy Policy. The Customer may request access, correction, deletion or object by contacting contact@petanqueland.fr.

Article 15 — Force majeure

The seller is not liable for failure to perform caused by force majeure as defined by law and case law, including disaster, strike, breakdown, carrier failure or another unforeseeable and unavoidable external event.

Article 16 — Customer service and complaints

For any question or complaint: contact@petanqueland.fr. The seller will reply as soon as reasonably possible.

Article 17 — Mediation and disputes

Under the Consumer Code, the Customer may use a consumer mediator free of charge to seek an amicable resolution after sending a written complaint to the seller. The Customer may also use the European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.

Article 18 — Applicable law

These terms are governed by French law. If no amicable solution is found, disputes fall under the jurisdiction of the competent French courts. By confirming an order, the Customer confirms having read and accepted these terms without reservation.

Confirming an order means accepting these general terms and conditions of sale.
